:chuckle: Its a flint island kind of thread...

ok. I've got ivy growing all over the back of my house. I like it. But my neighbour doesn't. He's been griping on about it growing over his side (its a terraced row of houses) for ages.

Anyway, he knocked on today. Griping about it as per...I told him to just cut it back from his side as much as he likes. As per.

But then today he starts up about 'legal responsibilites' etc....ie its my ivy, so I'm legally responsible for stopping it growing over his side. He said I need to poison it, & if I don't he'll take legal action. I told him (politely) to fuck off. :D

Anyway, he's legally in the wrong yes? Its comparable to a tree thats growing in my garden having branches that extend over the boundary into his property....he has the legal right to cut off the branches on his side, but I'm under no legal obligation to remove the tree right? (unless its causing a direct threat to his property of course, ie falling on it).

Thoughts?

My understanding is that your neighbour can cut back anything which intrudes on their property, (and in fact, should offer you the cuttings as the plant belongs to you).
Local by-laws can often complicate things though, so it may be worth giving the council a phone to check exactly what the deal is.

It could be a private nuisance (I'll give a link rather than type a lot... I've been typing all day!);

you should kill him and bury him under the ivy.

Thanks for that :)

Quote from it...
A legal action to redress harm arising from the use of one's property.

The two types of nuisance are private nuisance and public nuisance. A private nuisance is a civil wrong; it is the unreasonable, unwarranted, or unlawful use of one's property in a manner that substantially interferes with the enjoyment or use of another individual's property, without an actual Trespass or physical invasion to the land.

I can just see him going for that. In fact I'll bet he's recently read it :D

But he'll have a problem with ''substantially interferes with'' I think, because he has the simple option of just trimming the ivy back..

It might be worth checking that approach with the council too.
Just in case there are any consequences you may have unforeseen.
By-laws are tricksy buggers.

I love ivy

All this mentioning of ivy makes me think of this song by Kate Bush:

Under The Ivy

Nowt to do with ivy, just, just made me remember this :spliff:

I used to live next door to a bird man. To be blunt, the man was a total cunt.
Back then I had a really docile cat who never left the vicinity if he couldn't see the house - this is 100% the truth, that cat NEVER wandered in it's life.

Birdman fuck decided to fill his garden with averies one day and after about 3 weeks decided to start complaining to me constantly that my cat was scaring his birds. It wasn't mine that was doing it, my cat didn't give two shits about his birds nor anything else for that matter but the twat continued to blame my him. Please keep in mind, it was a village and FULL of FUCKING CATS!

Anyway, fast forward about 3 months and one day Sega (my cat) was gone. Nothing. Not a sign. No cat.

It was clear to me what happened to my cat and on this notion I confronted the fucker next door with this clearness in mind. He of course denied anything I may have accused him outrightly of but not convincingly enough. I KNOW he did it. Which is what then led me to proclaim to him that I knew he did it and that he best be good at sleeping with one fucking eye open because I was going to kill all his birds in return and that he'd have to catch me doing it.

Three nights later (which pleased me to know that he had spent the last 3 nights sweating about it) the law turned up to ask me if I had threatened to kill his birds. I told them yes, got a rollicking for wasting police time complete with a lecture on what I can and can't say EVEN if I don't mean it and then they left me be.

As I said, damn all to do with ivy but does have a nice wee moral.... don't have fucking neighbours (which I ain't ever had since) :D
